[1.] On
Sunday, November 17, 2002, the Respondent received a Notification of Complaint
and Commencement of Administrative Proceeding from the WIPO Arbitration and
Mediation Center (the Center) by e-mail
informing the Respondent that an administrative proceeding had been commenced
by the Complainant in accordance with the Uniform Domain Name Dispute
Resolution Policy (the Policy),
approved by the Internet Corporation for Assigned Names and Numbers (ICANN) on October 24, 1999, the Rules for Uniform Domain Name
Dispute Resolution Policy (the Rules),
approved by ICANN on October 24, 1999, and the WIPO Supplemental Rules for
Uniform Domain Name Dispute Resolution Policy (the Supplemental Rules). The Center
set November 27, 2002 as the last day for the submission of a Response by the
Respondent.

III. Response
to Statements and Allegations Made in Complaint
[5.] This
Response contests the ŇSummary of partiesÓ provided by the Complainant and
furthermore calls into question the extent to which the public may trust the
Complainant to accurately and fully represent its business practices on its Web
site. The Respondent requests that the panel take into account the following
additions during the proceedings.
[6.] Established
in 1953, Burson-Marsteller, LLC (The ŇComplainantÓ), to the extent that it and its trademark,
ŇBurson-MarstellerÓ (the ŇTrademarkÓ) are
commonly known outside of the public relations and advertising industries, has
a well-documented public reputation for its unethical business practices,
including for purposes of these proceedings but not limited to, working for
repressive political regimes, organizing consumer-front groups to create the
appearance of public support for harmful consumer products and unsustainable
environmental practices, minimizing public knowledge of critical consumer and
labor issues, exercising corporate influence over media outlets, and spying on
and harassing political activists as noted by the Center for Media &
Democracy in the 1995 book, Toxic Sludge is Good for You (see Annexes
10, 12, 13, and 14).
[7.] The
Respondent, Dexter L. Smith, is a resident of the State of New York and the
Commonwealth of Massachusetts, and owner of a cellular telephone purchased in
the Commonwealth of Massachusetts.
[8.] The Respondent hereby
responds to the statements and allegations in the Complaint and respectfully
requests the Administrative Panel to deny the remedies requested by the
Complainant, calling specific attention to the bases upon which the Complainant
formulates the argument before the panel, and highlighting the importance of
this dispute in securing the right to freely distribute and properly associate
with a trademark and the business practices of the trademark holder educational
material which is in the public interest and relevant to the well being of
citizens of the World Intellectual Property OrganizationŐs (the ŇWIPOÓ) member states.
A. The Domain is not Ňconfusingly
similarÓ to the Trademark, nor has the Respondent infringed upon the
intellectual property rights of the Complainant as alleged in the Complaint;
[9.] In
DLJ Long Term Investment Corporation v. Nucom Domain Name Brokers (before the National Arbitration Forum), the Respondent
specifically noted that the addition of a single character to the ComplainantŐs
domain, <bm.com>, would significantly change the nature of the mark.
RespondentŐs domain similarly subtracts a single character from another domain
owned by the Complainant, <burson-marsteller.com>. Furthermore,
respondent offers evidence contrary to the allegations made in Paragraph 13 of
the Complaint, which state, ŇÉa substantial degree of goodwill is associated
with [the Trademark]ÉÓ in Annex 13, including a newspaper headline in
which the Complainant is characterized as Ňthe Devil.Ó Respondent provides for
the CenterŐs convenience in Annex 5 evidence that while the Complainant
owns the mark ŇBURSON-MARSTELLER,Ó it does not own the mark,
ŇBURSONMARSTELLER.Ó
[10.] Respondent denies that the Domain is Ňconfusingly similarÓ to
the Trademark. In Paragraph 14 of the Complaint, Complainant incorrectly
interprets Paragraph 3(b)(ix)(1) of the Rules, alleging bad faith use as
evidence of a similarity between the ComplainantŐs trademark and the Domain.
Respondent notes that burden of proof is similarly conflated in Document
Technologies, Inc. v. International Electronic Communications Inc. (D2000-0270), in which the panelist states, ŇSuch an
approach is not supported by the clear wording of the Policy, which separates
the requirements in Paragraph 4(a) into three distinct elements, and provides
separate examples (Paragraphs 4(b) and 4(c)) of how to satisfy the second and
third factors.Ó A rebuttal of these and other allegations of bad faith is
provided appropriately in Paragraph 20 of this response.
B. The Respondent
has legitimate interests in the Domain and has demonstrated good faith use of
the Domain;
[11.] On July
14, 2002 the Respondent, legal owner and master of one domestic canine,
approximately one year of age, given on its date of birth the name ŇBursonÓ
after New York City-based artist Nancy Burson, in private consultation with the
RespondentŐs spouse, Cynthia Smith-Stackhouse, legal owner and master of two
domestic canines, named ŇWestinghouseÓ and ŇMarsteller,Ó respectively,
registered in good faith the Domain, with the intention to create a Web site
displaying photos of the aforementioned animals for friends and family members.
The Respondent denies any knowledge of the Trademark or of Burson-Marsteller,
LLC, prior to the registration of the Domain, noting that the ComplainantŐs
practice, by design (as it was formerly described by the Complainant, ŇPerceptions
Management,Ó see Annex 12), is
not commonly known outside of the public relations and advertising industries.
On or shortly after July 17, 2002, and ending on November 18, 2002, Respondent
did begin, after obtaining information from colleagues about Burson-Marsteller,
LLC and its business practices while contacting local colleges and universities
to obtain free web hosting, using a preexisting software program (the ŇSoftwareÓ, see Annex 2),
with free hosting services provided by the Yurt Media Center at Hampshire
College in Amherst, MA, for purposes wholly educational and not for profit and
acting on behalf of the best interests of the Complainant and general public
and in good faith, providing to visitors of the Domain a mediated viewing experience
of the ComplainantŐs Web site as shown in Annex 8 of the Complaint.
[12.] Annex 6
to this response indicates that the Domain was in fact owned and used in 2001
by a party other than the Complainant or the Respondent, establishing a pattern
of non-ownership of the Domain by the Complainant.
[13.] In
Paragraph 15 of the Complaint, Complainant alleges that Respondent has no
rights or legitimate interests in respect of the domain name because the
ŇDomain Name is being used in a confusing and deceptive manner to mislead
Internet users searching for Burson-MarstellerŐs web site into believing that
Respondent is somehow affiliated with Burson-MarstellerÉÓ when by ComplainantŐs
own demonstration, content displayed at the Domain prior to November 18, 2002,
as described in Paragraph 15 of this response, was in fact redirected from
ComplainantŐs own site. Far from misleading users, Respondent was actually
providing Complainant with further (and more clearly understandable) display of
<bm.com> than previously existed when the Domain was unregistered or was
registered to the parties shown in Annex 6; Internet users searching for
ComplainantŐs Web site and arriving at the Domain did in fact see ComplainantŐs
Web site. Respondent did not act in a manner that is consistent with
ComplainantŐs description of RespondentŐs Web site, nor would Internet users
have reason to believe the Respondent is affiliated with the Complainant as
such.
[14.] On
November, 18, 2002, the Respondent replaced the contents of the Web site displayed
at the Domain with a message that clearly indicates the third-party nature of
the site and RespondentŐs intention to provide in information about
Burson-Marsteller, and, as an act of good faith, provides a clearly labeled
hyperlink to the Web site of the Complainant, to remain online for the duration
of the proceedings, accompanied by a recommendation that visitors contact the
Complainant directly with inquires regarding its products and services (see Annex 10). RespondentŐs current Web site additionally
contains factual information and resources related to the ComplainantŐs
business practices, including a list of the ComplainantŐs current and former
clients, such as the Complainant has failed to do on its own, despite its
efforts at Ňbeing accountableÓ (see Annex
11(b)). The Complaint alleges that the ŇDomain Name is not being used in
connection with a bona fide offering of goods or services;Ó however, Domain is
currently being used to offer in good faith a valuable public information
service.
[15.] The
ComplainantŐs self stated goal is ŇÉto ensure that the perceptions which
surround our clients and influence their stakeholders are consistent with
realityÉÓ (see Annex 11).
Further to this goal, Respondent has a Ňlegitimate interest in the DomainÓ
where the Domain has been used to facilitate the ComplainantŐs own
representation of its brand by coordinating the presentation of Web pages via
intelligent dynamic filtering techniques which simplify language and, as shown
in the Complaint, more accurately represent the business of the Complainant
than the Complainant has done itself (examples, see Annex 12), thus increasing both the accountability
of the ComplainantŐs actions to the public and the quality and volume of the
ComplainantŐs business, and where the domain has and will be used to distribute
publicly available academic and journalistic materials about
Burson-MarstellerŐs involvement with and relationship to, for example, Philip
Morris and the National SmokerŐs Alliance, a consumer front group designed to
create the appearance of public support for big-tobacco policies (see Annex 14), Union Carbide and the deaths of 20,000
people following the 1988 disaster in Bhopal, and political regimes such as
that of Romanian dictator Nicole Ceaucescu and more recently Saudia Arabia
following the events of September 11, and to properly associate them with the
relevant Trademark so that they may be understood accordingly by Internet
users.
C.
The Domain was not
registered in bad faith, nor has it or is it being used in bad faith;
[16.] The Respondent registered the Domain in good faith, as
described in Paragraph 11 of this response. The Respondent has received no
contact whatsoever from the Complainant regarding the use of the Domain prior
to the filing of the Complaint, nor has the Respondent contacted or intended to
contact the Complainant to offer the domain for sale. The Domain has never
generated revenue for the Respondent, nor has the Respondent demonstrated
intent to use the Domain for commercial activities, nor has the Complainant
demonstrated how the Respondent might benefit financially from the use of the
Domain. The Complainant has failed to provide evidence that the Domain was
previously owned by the Complainant prior to 2001, and provides only anecdotal
evidence in the matter of the ComplainantŐs miscommunication with its former
registrar as a basis for the ComplainantŐs claim to the Domain. Therefore, the
RespondentŐs actions have not prevented the Complainant from continued use of
the Trademark in a manner that is consistent with a documented preexisting
ownership of the Domain by the Complainant, or a legal extension of the
Trademark to instances of the mark that omit the Ň-Ň symbol, as is the alleged
instance of the Trademark in the Domain.
[17.] In cases such as Telaxis Communications Corp. v. William E.
Minkle (D-2000-0005), the Center has
upheld the distinction between bad faith registration and bad faith use,
requiring that the Complainant demonstrate both bad faith registration and bad
faith use, in accordance with Paragraph 4(a)(iii) of the Policy, which states,
Ňyour domain name has been registered and is being used in bad faith.Ó In Vanguard
Medica Limited v. Theo McCormick
(D2000-0067), the panelist upheld good faith registration of a domain identical
to that of a trademark, despite failure to post content to the contested domain
consistent with intended use at the time of good faith registration, and
further noted that Ňsuspicion aloneÉ cannot suffice to prove that Respondent is
acting in bad faith.Ó The Complainant engages in such suspicion when it infers
a relationship between the Respondent and the organization ŇRTMARKÓ, when it
describes a server error as evidence of for-profit and when it characterizes
the RespondentŐs actions as Ňdisruptive.Ó
[18.] Respondent
denies relationship to the entity ŇRTMARK,Ó and to any materials, actions, Web
sites, or endorsements, express or implied, of that entity. Countless
organizations and individuals (ŇOnline EntitiesÓ), such as Yahoo!, offer persons wholly unaffiliated with
the Online Entity itself, without express or implied relationship therein, free
email services, including for technical reasons, email addresses that contain
the mark of the Online Entity or of Web sites belonging to the Online Entity,
and henceforth grant the user of such services the right to bear publicly the
email address, containing the mark, and to associate oneself with that email
address for purposes concurrent with those outlined in the Online EntityŐs
Service Agreement or similar document, or for no prespecified purposes should
the Online Entity chose not to require the user to comply with such an
agreement. Such services are offered only because it is commonly understood
that, while frequently used to denote a relationship between an individual and
an Online Entity, an email address is neither a guarantee nor evidence of a
relationship between the individual associated with the email address and the
Online Entity or its business. The Respondent therefore respectfully requests
that Annex 9 of the Complaint, which allegedly demonstrates illegal activity
sponsored by the entity ŇRTMARKÓ, and corresponding portions of Paragraph 17 of
the ComplainantŐs filing be deemed irrelevant and stricken from the
proceedings.
[19.] In Paragraph 17 of the Complaint, the Complainant continues to
infer from the RespondentŐs alleged relationship with the entity ŇRTMARKÓ, that
the Respondent is Ňmasking its true identity in this case,Ó without providing
any evidence whatsoever, factual or otherwise, to substantiate this claim. This
inference is then used to assert the Ňlogical assumptionÓ that the Respondent
has engaged in a pattern of conduct similar to that alleged in Paragraph 17 of
the complaint. The Respondent denies having engaged in misleading conduct with
respect to its identity or engaging in a pattern of conduct alleged by the
Complaint. Furthermore, the Respondent requests that the Center note the
misleading nature of these allegations and reconsider the basis for the
Complaint with respect to the ComplainantŐs use of conjecture to preemptively
discredit the Response contained herein. Complainant has failed to show that
Respondent registered the domain to prevent Complainant from reflecting the
Trademark, and that Respondent has engaged in a pattern of similar conduct as
required by Paragraph 4(b)(ii) of the Policy.
[20.] Complainant alleges bad faith use based on the Ňchanging
natureÓ of RespondentŐs Web site. During dates in October, 2002, for reasons as
yet to be determined and due to a misconfiguration of the Apache software used
to host RespondentŐs Web site, the Domain accidentally displayed a Web page
belonging to the organization providing free Web hosting to the Respondent (see Annex 7). For purposes of the proceedings, the Yurt
Media Center (the ŇYurtÓ) is a higher
education student campus organization and student building associated with
Hampshire College (the ŇCollegeÓ) and
operating on the campus of that educational institution which is located in
Amherst, MA, and providing to students of the College a number of services,
including but not limited to, access to recording equipment, various Web
services, free rental of audio equipment, etc. The Yurt is funded entirely by
the College and is neither a for-profit organization, nor does produce or
provide any commodities or services that could logistically be sold, especially
on the Internet, nor is it clear, given the nature of the organization, what
profits could be derived from such a practice. It is further unclear what
material on the YurtŐs Web site (ŇThe Yurt Media Center Internet Website
HomepageÓ, see Annexes 8(a) and 8(d))
prompted the Complainant to infer in Paragraph 14 of the Complaint, that Ňthis
version of the web site may have been established by Respondent for financial
gain in connection with downloading various media.Ó Complainant fails to
explain what benefit Respondent would gain from the purposeful temporary
display of the Yurt Web page, or in what way the Yurt and Burson-Marsteller,
LLC might be considered competitors as such. In addition, if the Center were to
rule that technical misconfiguration constitutes bad faith use, thousands of
everyday errors could be defined as bad faith.
[21.] Complainant alleges that RespondentŐs past use of the Domain
is not a fair use exception of copyright infringement, therefore alleging
infringement in the matter of the copying and display of content owned by the
Complainant by the Respondent. However, the software used by the Respondent as
shown in Annex 2 merely redirected requests for files on the Web site of
the Respondent, such as <index.html>, to derivatives of corresponding
files on the Web site of the Complainant, <bm.com>, generated dynamically
at the time of the user request and identical to the originating files except
where phrases had been substituted by the Software for simpler and more
transparent phrases. Furthermore, had Respondent used ComplainantŐs copyrighted
works in a manner consistent with infringement as defined by United States
Copyright Law of 1976, such use would certainly be a fair use as protected by
Title 17, Section 107 of that law, which states, Ňthe fair use of a copyrighted
work, including such use by reproduction in copies or phonorecords or by any
other means specified by that section, for purposes such as criticism, comment,
news reporting, teaching (including multiple copies for classroom use),
scholarship, or research, is not an infringement of copyright.Ó The
RespondentŐs alleged ŇuseÓ of the copyrighted work is consistent with the
values of criticism, comment, and education.
[22.] The Respondent, having not engaged in bad faith practices as
defined by the Policy, and noting that the Complainant has few legitimate
claims to Ňpublic trustÓ given the evidence before the panel, nor should a
measure of public trust garnered by the Complainant be reasonably considered
Ňhard-earnedÓ or Ňwell-deservedÓ with respect to the nature of the
ComplainantŐs business practices, discussed briefly in Paragraph 15 of this
response and extensively in the documents available on the RespondentŐs current
Web site, as alleged in Paragraph 18 of the Complaint, and working in the
interest of the ComplainantŐs self defined mission (see Annex 11), denies Ňtaking advantageÓ of the
Complainant as such.
IV. Administrative Panel
[23.] The
Respondent supports the ComplainantŐs election to have the dispute decided by a
single-member Administrative Panel.
[24.] A
copy of this Response has been sent or transmitted to the ComplainantŐs
authorized representative on November 27, 2002, by postal mail and e-mail.
[25.] This
Response is submitted to the Center in electronic form and in four (4) sets
together with the original.
[26.] The Respondent notes the ComplainantŐs
payment, as required by the Rules and Supplemental Rules, in the amount of USD
$1,500, by check, via Federal Express, to the World Intellectual Property
Organization.
[27.] The
Respondent agrees that, except in respect of deliberate wrongdoing, an
Administrative Panel, the World Intellectual Property Organization and the
Center shall not be liable for any act or omission in connection with the
administrative proceeding.
[28.] The
Respondent certifies that the information contained in this Response is to the
best of the RespondentŐs knowledge complete and accurate, that this Response is
not being presented for any improper purpose, such as to harass, and that the
assertions in this Response are warranted under the Rules and under applicable
law, as it now exists or as it may be extended by a good-faith and reasonable
